Introduction
These are the General Terms and Conditions for Distance Selling (hereinafter "GTC") of Royal Garden Unternehmergesellschaft (hereinafter "Royal Garden").
Royal Garden creates, designs and manufactures high quality clothing for men, women and children, fashion accessories, shoes and lifestyle products and sells these worldwide under the Royal Garden brand (together the "Royal Garden Products").
In order to best meet the needs of its customers, Royal Garden has set up a distance selling system for sales by telephone or internet.
Royal Garden is the owner of the domain name of the site.
The Website, in its entirety and in the elements of which it is composed (in particular texts, menu trees, software, animations, photographs, videos, illustrations, schemes, graphic representations, logos, etc.), constitutes a creative work protected by Directive 2004/48/EC. It is the exclusive property of Royal Garden, which alone is authorized to use the aforementioned intellectual property rights, as well as the related personal rights, trademarks, models, creative works, software, databases, evaluations, images of persons, whether original or by license or express authorization.
The partial or complete use of the site, in particular by downloading, reproduction, transmission, representation or distribution, for purposes other than personal and private, non-commercial use by the user is strictly prohibited. Anyone who violates the rights of Royal Garden will be subject to the penalties provided for by the German Intellectual Property Code, in particular in the case of copyright or trademark infringements, and by the German Civil Code in the case of civil liability.
§ 1 Scope
The following General Terms and Conditions shall apply to all contracts concluded with Royal Garden concerning the acquisition and supply of goods via the online store under the internet address www.royalgarden.store. Royal Garden does not recognise any deviating conditions of the customer unless these have been expressly approved as valid by Royal Garden.
§ 2 Prices and Shipping Costs
The prices quoted in the online store include statutory VAT. Every delivery is subject to a shipping fee of Euro 5,50 for deliveries within Germany. Shipping costs for delivery abroad can be found below.
§ 3 Ordering Process and Conclusion of the Contract
- Orders for goods may only be placed for normal quantities. Orders for commercial purposes shall not be permitted.
- Goods presentation in the online store shall not constitute a legally binding request to conclude a purchasing contract. Rather this presentation is a non-binding invitation to order goods from the online store.
- By clicking the “Order Now and Proceed to Payment” (“zahlungspflichtig bestellen”) button you issue a binding request for purchase (§ 145 of the German Civil Code (BGB)). To this end, prior to concluding the ordering process a confirmation window will appear in your display with the details of your order. Here you can check and correct your details once again.
- Once the purchase request has been received you will receive an automated mail reply confirming that we have received your order (confirmation of receipt). This confirmation of receipt still does not constitute acceptance of your purchase request. A contract shall not yet come into being merely on the basis of the confirmation of receipt.
- A purchasing contract shall only come into being when we expressly declare we accept the purchase request or if we send the goods to you – without any prior express declaration of acceptance.

§ 5 Methods of Payment
- Payment can be made either by:
bank transfer or debit card,
by credit card,
by PayPal - We accept the following credit cards: Mastercard, Visa and American Express. When paying by credit card you must inform us of the card number, the card verification code and the expiry date of the credit card. Upon issue of the invoice, the invoiced amount will be debited from your credit card.
We accept cards from the "CB" network, Visa©, Eurocard©, MasterCard©, American Express©, and Apple Pay©. Cards issued by banks based outside Germany must be international credit cards.
In order to use these payment methods when ordering by telephone, you must confirm to the customer service department and guarantee Royal Garden that you are the legitimate holder of the card used to pay for the order and that the first and last name on the card is your name. When ordering by telephone or via a secure website or third-party platform that sends a payment link, you must also provide the card number, expiration date and security code of the card.
When ordering via the Website, you will be redirected to a secure server operating in SSL mode (128 bit) after confirming your bank details.
This ensures that your transaction is carried out in accordance with the standards for secure banking transactions. The authentication process varies from bank to bank. By providing Royal Garden with your credit card or debit card number or bank account details by telephone or via the Website, you give Royal Garden your unconditional consent in advance to complete the secure transaction and authorize your bank in advance to charge your account upon receipt of the records or statements provided by Royal Garden, even if there are no invoices signed by the credit card holder.
If your credit card is charged before the items are dispatched or the purchase of the items has been expressly made by other means, the purchase contract is concluded at the time your credit card is charged. However, this does not apply to down payments or early payments that you make if your card is debited with the amount of the down payment on the agreed due date
§ 6 Delivery
Items can be delivered worldwide. If you order items and wish to have them delivered to a country other than those mentioned above, you must place your order on the relevant website (if available).
For security reasons, Royal Garden will not accept orders where a PO Box is specified as the delivery or billing address; deliveries will only be made to hotels or student residences if express delivery with proof of delivery has been selected for personal delivery.
You can also have items designated as gifts delivered to other people in Europe.
The items will be delivered to the address you specify when ordering. With this in mind, you must ensure that you provide Royal Garden with a correct delivery address.
The items ordered will be delivered as follows:
- on or within the date or timeframe specified to you by Royal Garden prior to confirmation of your order, or, if no timeframe is specified, no later than thirty (30) days from the date of order, unless there is a justifiable delay in delivery; or
- if the relevant item is temporarily unavailable, within the timeframe communicated to you and accepted by you (i) when you place your order by telephone with the Customer Service Department or (ii) when you add the item to your shopping cart on the Website and before you accept your order. This also applies to pre-orders placed via the Website.
If not already done beforehand (e.g. when paying via PayPal), the purchase price will also be debited when the item is dispatched.
Depending on the delivery method selected by you, Royal Garden will send the ordered items as a standard shipment or via express courier service with proof of delivery to your own hands or for collection from a store.
In the case of delivery by express courier service with proof of delivery to own hands, the costs will be borne by the customer, unless the costs exceed one thousand three hundred euros (EUR 1,300) - in which case Royal Garden will bear the costs. The costs for express delivery will be displayed before you confirm your order.
If delivery of the items is delayed due to an event beyond Royal Garden's control, you will be contacted immediately and steps will be taken to mitigate the effects of the delay in delivery. Provided that Royal Garden makes every effort to shorten the delay, Royal Garden will not be liable for the delay caused by this event. However, if there is a risk of significant delay, you may contact Royal Garden to cancel the contract and obtain a refund for any amounts you have already paid for items not yet received.
If the goods ordered by the customer cannot be delivered for reasons for which the customer is responsible (e.g. due to an incorrect delivery address or due to the customer being absent several times during delivery attempts), the customer shall be charged for the additional costs incurred as a result of the delay in acceptance.
If the goods cannot be delivered, they will be stored with the delivery service for a maximum period of [7 days], unless otherwise agreed with the delivery service, and another delivery attempt will be made. If the carrier is unable to redeliver the parcel, the parcel will be returned to the Royal Garden warehouse and Royal Garden will attempt to contact you again within two (2) weeks of receipt of the parcel at the warehouse to redeliver the parcel. In the event of a re-delivery by Royal Garden, the customer shall bear the costs of the re-delivery. If a new delivery by Royal Garden fails or if the customer does not respond to the contact or does not respond in time, Royal Garden is entitled to withdraw from the purchase contract. In this case, Royal Garden will refund the order value minus any costs for the repeated delivery and send an e-mail confirmation to the address you provided when ordering.
§ 7 Undeliverable Items
If we do not accept an order for this reason, because the ordered item is no longer available, we shall inform you of this immediately. Any payments effected shall in this case be reimbursed.
§ 8 Warranty
Unless otherwise agreed, your warranty claims shall be determined by the legal provisions of the sales law (§§ 433 et seq. of the German Civil Code (BGB)).
§ 9 Intellectual Property
Any intellectual property rights pertaining to any Royal Garden product or element (including Royal Garden Items), such as trademarks, illustrations, photos, images, models, designs and logos, whether registered or not, is and will remain the exclusive property of Royal Garden.
Any total or partial reproduction, downloading, modification or use of Royal Garden 's trademarks, illustrations, images, photos, logos and designs, for direct or indirect commercial use and on any medium whatsoever, without the express prior written consent of Royal Garden, is strictly prohibited.
§ 10 Ownership of the Items
The goods remain our property until full payment has been made.
§ 11 Dispute Resolution
The European Commission has set up a platform for online dispute resolution (ODR) that you can find here: http://ec.europa.eu/consumers/odr/. We are legally bound to state these details. We shall, however, not take part in this kind of dispute resolution.
§ 12 Applicable Law
For all disputes arising or on the basis of this agreement German law shall apply with the exception of the UN sales convention. This choice of law shall only apply to the extent that the consumer is not denied obviously applicable consumer protection provisions of the country the consumer has their usual place of abode in at the time of their order.
Consumers within the EU:
For the out-of-court dispute resolution of consumer law disputes, the Commission of the European Union has set up an online platform ("ODR Platform") which you can access for the purpose of resolving an out-of-court dispute. The platform can be found at "http://ec.europa.eu/consumers/odr/".
We are neither prepared nor obliged to take part in dispute resolution proceedings before a consumer arbitration body.

Cancellation Policy
Right of Cancellation
You are entitled to cancel this contract within fourteen days without the need to state your reasons.
The cancellation deadline shall be fourteen days from the day you or a third party named by you who is not a carrier, take(s) possession of the goods.
To exercise your right of cancellation you must inform us at Royal Garden, Hansaring 10, 50672 Cologne, mail: info@royalgarden.store of your decision to cancel this contract by means of a clear declaration (e.g. a letter dispatched by post, by telephone, fax or e-mail).
To safeguard the right of cancellation it shall be sufficient for you to send off the cancellation notification before the cancellation deadline.
NOTE: in all cases, whenever you wish to cancel because you have changed your mind, and where these terms and conditions permit such cancellation:
You must return all relevant Items to Royal Garden in an unused condition and in their original packaging; and we are permitted to make a reduction to any Refund, up to the full purchase price of the Item, to take account of any damage to, or usage or handling of, an Item that affects its value. Please, therefore, be careful.
Consequences of Cancellation
Should you cancel this contract we must, immediately and within fourteen days from the day notification of cancellation has been received by us, pay back to you all payments received from you including the delivery costs (with the exception of additional costs arising from you selecting a means of delivery other than our standard, least expensive delivery service). For this repayment we shall use the same method of payment used by you for the original transaction unless another arrangement was expressly agreed with you; under no circumstances shall fees be charged to you as a result of this repayment.
We can refuse repayment until we have received the returned goods or until you have provided proof that you have returned the goods, depending on whichever comes first.
You must return or hand back to us the goods immediately or in any case within fourteen days from the day on which you inform us of your wish to cancel this contract. The deadline is honored if you dispatch the goods before the fourteen-day deadline has expired.
You shall bear the immediate costs for returning the goods.
You must only cover any loss in the value to the goods if this loss in value is attributable to treatment not necessary for the inspection of the properties, features and functioning of the goods.
Shipping Disclaimer
Royal Garden is a very young brand. All garments are hand-sewn and each order is assembled, prepared, and packaged by hand. With that amount of love included in each shipment, longer or delayed delivery times may occur. We thank you for your understanding.
